Applicant’s Request

The application for discharge review was received on 20031006. The Applicant requests the characterization of service received at the time of discharge be changed to honorable. The Applicant requests a documentary record discharge review. The Applicant did not list any representative on the DD Form 293.

Decision

A documentary discharge review was conducted in Washington, D.C. on 20040812. After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, no impropriety or inequity in the characterization of the Applicant’s service was discovered by the NDRB. The Board’s vote was unanimous that the character of the discharge shall not change. The discharge shall remain: GENERAL (UNDER HONORABLE CONDITIONS)/MISCONDUCT, authority: MARCORSEPMAN Par. 6210.3.

1. “I am requesting my discharge to be upgraded to an Honorable Discharge because prior to and after my discharge I can now see what type of person I was. At the age of 19, I was young and immature, my mind and body were focused on something else, my fiancée at the time, K_ R_. I have grown mentally and physically, and now I want to further my career and my life by becoming a Network Engineer, working on computers and their systems is something I have wanted to do for a long time. I believe, now, I deserve the opportunity to further myself utilizing the GI Bill.”

On 971001, my suspended punishment from NJP held on 980820 was vacated for violation of Article 86, UA from restriction muster and violation of Article 92, violation of restriction orders. On 971001, I received my second NJP for violation Article 86, UA from restriction muster and violation of Article 92, violation of restriction orders. 980422:  SJA review determined the case sufficient in law and fact. I do not, however, concur with the recommendations of the Commanding Officer, Marine Wing Support Group 17, and the Commanding Officer, Marine Wing Support Squadron 171, that the Marine be discharged with an Under Other Than Honorable Conditions characterization. Per paragraph 1004 of the reference (MCO 1900.16E (MARCORSEPMAN)), where an individual has been convicted at a special court-martial, for the same offense(s) which form the basis of the proposed administrative separation, and the individual has been retained by that same special court-martial, nothing less than a General (under honorable conditions) discharge shall be ordered unless approval is received from the Secretary of the Navy. Therefore, I believe the SNM should be discharged with an General (under honorable conditions) characterization by reason of misconduct due to a pattern of misconduct.

980424:  GCMCA [Commanding General, 1 st Marine Aircraft Wing] directed the Applicant's discharge general (under honorable conditions) by reason of misconduct due to a pattern of misconduct.


PART III – RATIONALE FOR DECISION AND PERTINENT REGULATION/LAW

Discussion

The Applicant was discharged on 19980624 under other than honorable conditions for misconduct due to a pattern of misconduct (A and B). The Board presumed regularity in the conduct of governmental affairs (C). After a thorough review of the records, supporting documents, facts, and circumstances unique to this case, the Board found that the discharge was proper and equitable (D and E).

Issue 1. The Applicant contends that his problems in the Marine Corps can be attributed to his being "young and immature." While he may feel that his immaturity was the underlying cause of his misconduct, the record clearly reflects his willful misconduct and demonstrated he was unfit for further service. The evidence of record did not show that the Applicant was either not responsible for his conduct or that he should not be held accountable for his actions. Relief denied.

The Veterans Administration determines eligibility for post-service benefits not the Navy Discharge Review Board. There is no requirement or law that grants recharacterization solely on the issue of obtaining Veterans' benefits and this issue does not serve to provide a foundation upon which the Board can grant relief. Additionally, the Board has no authority to upgrade a discharge for the sole purpose of enhancing employment or educational opportunities. Regulations limit the Board’s review to a determination on the propriety and equity of the discharge.

The Applicant remains eligible for a personal appearance hearing, provided an application is received, at the NDRB, within 15 years from the date of discharge. The Applicant can provide documentation to support any claims of post-service accomplishments or any other evidence related to his discharge at that time. Representation at a personal appearance hearing is recommended but not required.

A. Paragraph 6210, MISCONDUCT , of the Marine Corps Separation and Retirement Manual, (MCO P1900.16E), effective 31 Jan 97 until 31 Aug 01.

B. The Manual for Courts-Martial authorizes the award of a punitive discharge if adjudged as part of the sentence upon conviction by a special or general court-martial for violation of the UCMJ, Article [e.g., Article 86, unauthorized absence for more than 30 days].
